LABOUR
The Child Labour (Prohibition and Regulation) Act. 1986 is in force in this
territory. In pursuance of the directions contained in the Hon’ble
Supreme Court of India’s
judgment in W.P. No. 465, M.C. Mehta V/s Statem of
Tamil Nadu & Others, we had conducted survey to
ascertain employment of child labour in the
territory. Survey conducted by the Administration shows that no child labour is employed in 656 non-hazardous industrial
establishments. The labour enforcement officer has
been appointed as Ex-Officio Inspector under the said Act. The Administration
has also appointed the Mamlatdar, Land Reforms
Officer – I and II and the Development & Planning Officer, Dadra &
Nagar Haveli as inspectors for their respective areas for the purpose of
securing compliance with the provisions of the said Act. The Child Labour Rehabilitation – Cum – Welfare Fund has been
constituted to manage the affairs of the fund. A special Cell has been created
to supervise work relating to child labour and
co-ordinate activities and supervise work relating to child labour
and co-ordinate activities and supervise the work of conducting survey, ensure
deposition of amounts by inspectors recovered from employers and other related
matters. The UT of Dadra & Nagar Haveli is administered by the Central
Government and therefore question of giving grant to the voluntary agencies to
run vocational training centers for rehabilitation of tribal child labour etc. does not arise.
The regular inspections
are carried out to ensure that no Child labour is
employed. Incidence of child labour in the factories
has not been observed. We shall take all necessary measures to ensure that a
case of child labour is sternly dealt with.
BONDED
LABOUR
The Bonded Labour System (Abolition) Act, 1976 is in force in this
territory. As out territory is Central administered Union Territory
without legislature, we don’t have a debt Bondage Abolition Act or a
Regulation. The debt bondage is not prevalent in this territory. In compliance
to the directions issued by Hon’ble Supreme Court in
the W.P.No.3922/85, Public Union for Civil
Liberties V/s State of Tamil Nadu & others, a survey was
conducted to ascertain if there is any Bonded Labour
or System of Bonded Labour was found in the course of
the said survey. We have already found in the course of the said survey. We
have already constituted a Vigilance Committee on Bonded Labour
to initiate and review measures to prevent bondage, enforce and implement the
provisions of the said Act, utilization and implement the provisions of the
said Act, utilization of fund and to deal with identification, release and
rehabilitation of Bonded Labour has been constituted.
A Bonded Labour Monitoring Centre has also been
established for the District of Dadra & Nagar Haveli as directed by Hon’ble Supreme Court. the subject
of Bonded Labour is continuously reviewed at regular
intervals. Incidents of Bonded Labour
in the territory has not been observed. The Administration of Union Territory
of Dadra & Nagar Haveli is live to the problem and we will take all
necessary measures to ensure that a case of bonded labour
is sternly dealt with. The inter-state migrant workers are brought mainly for
the work of construction of buildings and roads. No seasonal migration in
search of employment and work on agricultural and cash crops is noticed. The
provision of the Inter-state Migrant Workmen (RE & CS) Act, 1979 is
effectively enforced to ensure that migrant labour is
not subjected to exploitation in any form.
